Spammers are going to go to jail in Virginia.

:D I just saw this on CNN.com and personally I think it’s a great idea. I know I’m tired of being harassed to buy porn or weight reducing pills. I'm 5'8 & 160Lbs for peet sake. If I want that crap it’s not hard to fine on here. Hell I get spammed talking to people on ICQ and it really gets on my nerves. I think this should be a Federal Law not just a state law for Virginia. Why should they get all the luck? What do the rest of you think?

Absolutely. If you tell someone that the people in 9/11 deserved to die it's okay, but if you tell someone they should buy tickets to NYC they get jailed. Makes perfect sense.

They've got a right to advertise. Should you ban ads and commercials by radio, mail, and TV, too:D? Just hit the delete button on your inbox guys.

Look, I hate email advertisements too, but I think jail is too strict, unless it's something you can't block (continuerly changing subject header, etc.), like in the article.

Shoot, half of the spam pop-ups I get are ads for Pop-Up Blocker programs. Make the madness stop!!

I am glad to read that someone is trying to do something about it and I sincerely hope this catches on in the other states.

Pop up's and porn e-mail are no better than harassment. People don't stop watching TV or listening to the radio, because of advertisements, but they do stop using the net.

There is a big deference between a Pepsi commercial on TV and the pop up selling porn and blow up dolls. It's offensive to most people. There is lots of advertising on the net that is tolerable such as banners and the like. Besides a law on junk e-mail there should be a law against junk mail and telemarketers. It's no different than some psycho sending you nude pictures of him self in a wig.

I know you're not going to like this. I have MSN mail not subscribed, but the free type. No not Hotmail. I never get SPAM on it for the most part. Yahoo and everything else I have is bombarded.

Spammers must pay. The threat, if carried out, of jail time and stiff penalties will definately affect the way they do business. But I suspect that most will simply switch to off-shore, out of country servers to defy regulations of individual states.

Still, it will definately begin cleanup of a dirty business.

One thing about spam to consider, however: if somebody wasn't spending money based on their ads, they wouldn't do it. So whoever you are, STOP! :p

Banner ads aren't the same.

You email is your private business. How would you feel if you got 5 snail mails an hour in your real mail? Not very funny then, is it.

It's illegal too. What often happens when you click the "I don't want any more of your junk ads"-button, is that they just send you more instead. As you've now shown yourself as an active user of that particular email adress, they'll begin an even bigger bombardment. Absolutely disgusting.

In the real world, you can say now to ads and commercials simply by placing a sticker on your mail box. Online however, there's no way to stop it. Ideally, you should be able to click a similar button on your email account - "No spam mails", and then you're spam free.

I'm glad these b*tches get what they deserve. Seriously, I can't use my hotmail account any more. I get around 300 spam mails a week, and I'm drowning in this junk.

Look, spamming is so cheap that only one in [hugenumberhere] web-users has to be gullible enough to go for it.

I think that with such a thing as the Internet, we'll have to impose international regulations, or, as Skin said, the spammers will merely move off-shore. But, basically, I think that e-mail should, legally, be considered the same as snail-mail or faxes (they are in Denmark, where it is by the way forbidden to send advertisements that haven't been specifically asked for (not that it's the most heavily enforced law...)).

Other than that, I have nothing to add to what has already been said.

BTW: Neat sig, Cosmos Jack. Can I "borrow" it?

I checked my mail on tuesday. I got 77 new mails of which 30 got past all the blocks and junk mail filters.

So should spammers be put in jail? No. They should be repeatedly anal raped by those 14" dicks they promise people will get after swallowing 2 little pills.

Seriously: a fine. A big fine. Spamming is illegal. You can't advertise without permission. Then there's the other thing that I'm not even trying to translate about "hindering communication".

Putting them into jail would be overkill. The system has to be coherent. Besides; a day in jail costs the society (at least ours) about 500 $. It's better to make 'em pay.

Come on (Not just you Mydnight, your post just embodied my point perfectly)...

Now, granted, YES. These guys are jerks. It's a pain to have to wait for NET SEND to turn off every time I reboot so I don't get those annoying pop up messages. (Ironically, now they have 'Pop Up Stopper' ads in the pop ups...).

But come on, it's almost like sending telemarketers to jail. Yes, they're incredibly annoying, but should we ship them off to jail? I think we should just impose a large fine.

Edit: Hmm... Never read Luc's post till now. Great minds think alike ;)

Well if they were just going to put them in jail I would understand. By doing that you also leave them with all the crap they gained from the Spamming and they will get out and do it again mush like a drug pusher. There going to RAPE them like a MOFIA bust.
They are going to take all their crap. So after all is said an done they will be out on the street giving $5 hand jobs to get by. They might go back to there spamming ways, but not after they have to get all the money to get the computers and crap they need.

Confiscating their comps would be a great idea. That and a fine.
Plus perhaps a conditional fine that won't allow them to sign up for internet access. No access to the net for spammers! If you can't behave, stay out! :D

(Oh and mustn't forget about the 14" anal rape)

If someone would take away my comp, forbid me from getting a new one or at least deny the right to an internet connection...wow...I'd be so pissed! :D

LMFAO! :D :D :D

I have to agree that jail is a bit much for spamming, but there definately needs to be some penalty that will get their attention. Some sort of public humiliation? Carry a sign around town that reads, "I'm a spammer?"

That probably would eliminate spammers through "natural selection." Spammers with signs wouldn't live long (fed up/angry citizens stoning them an all) and therefore this mutation of society would die off rather than reproduce :p

At least with telemarketers, one has the ability to interact in ways that annoy them back (assuming it's not a recording). I can't tell you how many long-distance service providers I've argued that I don't actually have a telephone, but rather a can on a string. (One would think that it's the quality of the can that is important here, but actually having a very good string gives the best audio quality).

True enough, spamming is the cheapest form of advertisment since it is very much like direct mail, but you only really have to mail one copy and have it go to many receipients. No printing costs, postage, envelope costs... etc. You don't even have to pay wages to the computer that spends all night "wardialing" multiple email addresses.

Take their computers / internet access away! That definately will deter them! Jail might be better (at least they have internet ;) ).

I think the real answer, however, will be some form of citizen activism. Although it'll increase overall bandwidth use, bouncing messages back the way some spam filters can might be the answer, but only if MOST internet users do it.

AOL is screwed, though, in my opinion. Its architechture seems too conducive to spam, stalking, etc.

I still laugh when I think about that American cleptomaniac who got sentenced to 9 months without TV. Under pressure, the judge eventually gave him a milder punishment which he was grateful for: Jailtime.:DLMAO!

Back on topic, though: I stilll stand on my point that jailtime is overkill. Give them a fine and, hmm, banning them from comp use sounds great to me:).

You can turn off telemarketers by switching channels. They don't invade your private mailbox either.

But no, they don't deserve jail.

A fine to compensate for all the time I've spent on deleting their junk, and salvaging important mails will do nicely. Oh, and multiply this fine by the amount of innocent people subjected to this crap.

Hmm it seems like all of you seem to look as jail like getting executed? If they were going to be executed then I would understand the arguments. It's just a little jail time for something that is illegal and that has gone long to long untouched.

People can do a lot of constructive things in jail besides getting rammed by Big Bubba. One of the things they can do there "think of something else to do other than harass people and costing corporations money." A lot of people won't use the net, because of SPAM and pop ups.

The problem is even popping up and cell phones now except for that the user gets charged for the message they get. So now it will cost the cell phone user money to get junk mail. I wonder how many people will stop using cell phones, because of junk mail.

I agree, jail is a bit too much.

But the punishment needs to have an effect. Recently, a company in Denmark was charged 15.000 Kr (about 2000 Ђ) - while it's admirable that some people's complains are heard and dealt with, everyone agreed the fine was far too small. 2000Ђ is peanuts compared to how much money they make with spamming. And those that complained were just the visible tip of the iceberg, the incredibly huge majority did not complain, yet were still harassed.

The fine needs to be enormous. It should be an incentive to make them rethink what they're doing, and hopefully make them stop.

Fined them and put them in jail tell their court date. Their court date just happens to be 6 months away. Have their bail set at their net worth and than at their court hearing fine them their net worth.

A good punishment would be to get the people responsible for popups, sit them in front of a p.c, fire a million popups at them and make em sit there without sleep or food or drink until they have closed em' all!

While I don't really like the idea of spam that much, I want to point out a few things. A lot of random spam email is sent to free email accounts (hotmail, yahoo mail, etc.) because spammers know lots of people use those. Also, you have absolutely zero right to complain about spammers on your free email account. If you cannot afford your own address, or your own mail server, etc, and choose to use someone else's for free...well, you get what you pay for. Also, I don't know about other people, but I have about three email accounts provided to me by my isp and they each have recieved a whopping amount of zero random spam emails. If @hotmail.com is somewhere in your email address, you might as well replace it with @spam.me.please.

If you do not use a free email service, and still recieve spam, it is because you have given your address out to a less then honorable source. These people either spam you themselves, or sell your address. This is exactly how telemarketers operate. Except with telemarketers, you can actually make them stop. A simple solution here is to either not give out your email address to everyone who asks for it, or have a seperate email account that you use in those situations that you must give an email address.

Pop ups are annoying, yes, but easily avoided. All it takes is a simple understanding of what a DNS server is and what it does, and what your hosts file is (for all you windows users). You can avoid banner ads in this fashion as well. If you choose to use cookies to make web browsing easier and faster, then you also choose to accept the negative side of it as well. If you install a program that also has spyware/adware, then it is a choice you make.

Point is, you can avoid all this spam if you wanted it. You just have to put in the effort, or invest the time to gain knowledge on how to avoid it. I don't get spam in my personal email account. I don't get pop-ups. I don't see banner ads. It costs me absolutely nothing to do this, and about two minutes of my time.

I also don't get calls from telemarketers, as I have taken the time to find out how to prevent them.

Funny how many people are annoyed with SPAM but don't take the time to fight it.

Problem with the laws are that they are not enforceable. If I am in Virginia and I use an open relay SMTP in some other country, the world is my oyster, the Virginian authorities can't do a thing to me.

You guys need to read up on anti-SPAM theory. Ultimately, even if you know how to fight spam, there's IP spoofing that blocks the **** of justice from toppling the SPAM empire.

The responsibility is up to the individual then. You must NEVER give your email out to people who give THEIR email out, and you must always be diligent in keeping your email address sanctified!

Which part, the open relay part? There's plenty of pro-SPAM organizations which would give you this info, the answer fot the mail admin is to 'close' your relay and turn up SMTP AUTH, so only the users of your mail system can send email out on it. This is better than systems which use reverse PTR lookups because those can be tricked into SMTP relay through IP spoofing. Nothing beats SMTP AUTH that I've seen.

If you are a spammer, go ahead and use an open relay, eventually they either get blocked off by black lists and you won't be able to send, or they close their relay in some shape or fashion, or force the SPAMer to commit bigger crimes of hacking and IP spoofing.

If you spam, then that's not really a tip, common knowledge I suppose. But the blacklist is more of a punishment against those who have open relays, not against spammers who use them. If someone is abusing a flaw in your mail server, is it justified to blacklist you?

If someone came into my house without my knowledge or consent, and used my phone to make soliciting calls, would it be right to add my phone number to a list of numbers that should be blocked, just because I forgot to lock my doors?

Get rid of spam!

Anyway I just wanted to post because at least once in the thread ICQ spam was mentioned. It's really easy to avoid ICQ spam (or seems to be). I always keep my ICQ on invisible anyway and I either rarely or never get spam on ICQ. The few times I've gone visible I know I've gotten spam while online and if I've ever gotten it otherwise it was while I was offline and was there when I got back on. So there's a hint: hide from spam ;).

Yup, but you shouldn't have to.

Banners on sites you visit - fine by me.

Pop-ups - annoying like hell, but since it is so very, very cheap it only takes a few suckers to make it worth the advertiser's while as another poster pointed out. Should be outlawed.

Spammail - Ought to be avoided through the same means as the stickers on RL mailboxes, and as easily.

Links popping up on your Desktop and in your Browser Favorites - Direct invasion of privacy. It's the equivalent of a man walking into your house/flat and putting up posters on your walls, and if you tear them down he'll be back the next day with new ones. Yes, my system is connected to the internet and therefor connected to all kinds of information traffic, but my flat is also connected to the community road/street system, but that gives no one any right to walk into my home unless I invite them. It's a violation of constitutionally protected privacy - ought to damn well be enforced too.

"Jubatus" I think you pretty much summed it up that's the way I feel about it.

Anyway... has anyone ever been to Hawaii? I lost count on how many times I have walked down the street while being bombarded with people trying tell sell me trips, dinners, and crap. Kind of like logging on the net and getting spamed. Hell half the time they would ignore me, because I was white and they were trying to sell stuff to just Japanese people. Which I didn't mined.

Though one time I got harassed by a cute little British girl to take a tour of Hawaii. I didn't mined that. ;)
