I think your MAIN problem is:

You have to say in the Readme, AND all over the site that:
"This MOD is NOT, supported, licenced, or created by Nintendo or any of it's affiliates. Super Smash Brothers, Super Smash Brothers: Melee all names, characters, logos, and copyrights are copyright 1999-2001 Nintendo and/or HAL Laboratory, Inc. unless otherwise noted".
Just copy most of the licence agreement and copyright info from the Super Smash Bros. manual, then edit it to basically say all stuff like that.

Also say something like:

"SSB:M MOD is strictly a nonprofit team of individuals, who recieve no monetary or capital gain in the creation and/or release of this MOD. SSB:M MOD team have no affiliation with Nintendo, LucasArts, Raven or any of their affiliates."

Also copy licence agreement from LucasArts/Raven, just to be safe.
When they see all that, they won't even bother with a lawsuit, because they really can't touch you, unless you're making money off of it.

Look at the bottom of the readme that came with the Link model. It's all there, to keep me out of legal trouble (Haven't heard from Nintendo at all).

Nintendo doesn't even bother reading requests, because they don't want to pay someone, or waste time - reviewing every situation, and then writing up a custom licence agreement.
